التعديلات على تطبيقنا

يتم توفير خدمات الطرف الثالث والروابط المؤدية إليها فقط كوسيلة راحة لك ويمكنك الوصول إليها واستخدامها على مسؤوليتك الخاصة بالكامل وتخضع لشروط وأحكام هذه الأطراف الثالثة.

المدة والإنهاء

تظل هذه الاتفاقية سارية المفعول حتى يتم إنهاؤها بواسطتك أو بواسطتك.

عند إنهاء هذه الاتفاقية، يتعين عليك التوقف عن استخدام التطبيق بالكامل وحذف جميع نسخ التطبيق من جهاز الكمبيوتر الخاص بك.

إن إنهاء هذه الاتفاقية لن يحد من أي من حقوق أو سبل انتصاف "لغز الحروف" بموجب القانون أو العدالة في حالة انتهاكك (خلال مدة هذه الاتفاقية) لأي من التزاماتك بموجب هذه الاتفاقية.

إشعار انتهاك حقوق الطبع والنشر

أنت توافق على تعويض "لغز الحروف" وشركاتها الأم وفروعها والشركات التابعة لها ومسؤوليها وموظفيها ووكلائها وشركائها والجهات المرخصة لها (إن وجدت) وحمايتها من أي مطالبة أو طلب، بما في ذلك أتعاب المحاماة المعقولة، بسبب أو ناشئة عن: (أ) استخدامك للتطبيق؛ (ب) انتهاك هذه الاتفاقية أو أي قانون أو لائحة؛ أو (ج) انتهاك أي حق لطرف ثالث.

لا يوجد ضمانات

يتم توفير التطبيق لك "كما هو" و"كما هو متاح" ومع جميع العيوب دون ضمان من أي نوع. إلى الحد الأقصى المسموح به بموجب القانون المعمول به، فإن لغز الحروف، نيابة عن نفسها وبالنيابة عن الشركات التابعة لها ومرخصيها ومقدمي الخدمات التابعين لها ولكل منهم، يتبرأ صراحةً من جميع الضمانات، سواء كانت صريحة أو ضمنية أو قانونية أو غير ذلك، فيما يتعلق بالتطبيق، بما في ذلك جميع الضمانات الضمنية للتسويق والملاءمة لغرض معين والملكية وعدم الانتهاك، والضمانات التي قد تنشأ عن مسار التعامل أو مسار الأداء أو الاستخدام أو ممارسات التجارة. دون تقييد لما سبق، لا تقدم لغز الحروف أي ضمان أو تعهد، ولا تقدم أي إقرار من أي نوع بأن التطبيق سوف يلبي متطلباتك، ويحقق أي نتائج مقصودة، ويكون متوافقًا أو يعمل مع أي برنامج أو أنظمة أو خدمات أخرى، أو يعمل دون انقطاع، أو يلبي أي معايير للأداء أو الموثوقية أو يكون خاليًا من الأخطاء أو أن أي أخطاء أو عيوب يمكن أو سيتم تصحيحها.

دون الحد من ما تقدم، لا يقدم لغز الحروف ولا أي من مقدمي خدمات لغز الحروف أي تمثيل أو ضمان من أي نوع، صريحًا أو ضمنيًا: (أ) فيما يتعلق بتشغيل أو توفر التطبيق، أو المعلومات والمحتوى والمواد أو المنتجات المضمنة فيه؛ (ب) أن التطبيق سيكون دون انقطاع أو خاليًا من الأخطاء؛ (ج) فيما يتعلق بدقة أو موثوقية أو حداثة أي معلومات أو محتوى يتم تقديمه من خلال التطبيق؛ أو (د) أن التطبيق أو خوادمه أو المحتوى أو رسائل البريد الإلكتروني المرسلة من أو نيابة عن لغز الحروف خالية من الفيروسات أو البرامج النصية أو أحصنة طروادة أو الديدان أو البرامج الضارة أو القنابل الموقوتة أو المكونات الضارة الأخرى.

لا تسمح بعض السلطات القضائية باستثناء أو تقييد الضمانات الضمنية أو القيود المفروضة على الحقوق القانونية المعمول بها للمستهلك، وبالتالي قد لا تنطبق بعض أو كل الاستثناءات والقيود المذكورة أعلاه عليك.

حدود المسؤولية

على الرغم من أي أضرار قد تتكبدها، فإن المسؤولية الكاملة لـ "لغز الحروف" وأي من مورديها بموجب أي حكم من أحكام هذه الاتفاقية وعلاجك الحصري لكل ما سبق يقتصر على المبلغ الذي دفعته فعليًا مقابل التطبيق.

إلى الحد الأقصى المسموح به بموجب القانون المعمول به، لن تكون شركة لغز الحروف أو مورديها مسؤولين بأي حال من الأحوال عن أي أضرار خاصة أو عرضية أو غير مباشرة أو تبعية مهما كانت (بما في ذلك، على سبيل المثال لا الحصر، أضرار خسارة الأرباح، أو خسارة البيانات أو المعلومات الأخرى، أو انقطاع الأعمال، أو الإصابة الشخصية، أو فقدان الخصوصية الناشئ عن أو المتعلق بأي شكل من الأشكال باستخدام أو عدم القدرة على استخدام التطبيق أو برامج الطرف الثالث و/أو أجهزة الطرف الثالث المستخدمة مع التطبيق، أو بخلاف ذلك فيما يتعلق بأي حكم من أحكام هذه الاتفاقية)، حتى إذا تم إخطار شركة لغز الحروف أو أي مورد بإمكانية حدوث مثل هذه الأضرار وحتى إذا فشل العلاج في تحقيق غرضه الأساسي.

لا تسمح بعض الولايات/السلطات القضائية باستثناء أو تقييد الأضرار العرضية أو التبعية، وبالتالي قد لا ينطبق عليك التقييد أو الاستثناء المذكور أعلاه.

قابلية الفصل

إذا تم اعتبار أي حكم من أحكام هذه الاتفاقية غير قابل للتنفيذ أو غير صالح، فسيتم تغيير هذا الحكم وتفسيره لتحقيق أهداف هذا الحكم إلى أقصى حد ممكن بموجب القانون المعمول به، وستظل الأحكام المتبقية سارية المفعول بالكامل.

تشكل هذه الاتفاقية، إلى جانب سياسة الخصوصية وأي إشعارات قانونية أخرى تنشرها "لغز الحروف" على الخدمات، الاتفاقية الكاملة بينك وبين "لغز الحروف" فيما يتعلق بالخدمات. إذا اعتبرت محكمة مختصة أي حكم من أحكام هذه الاتفاقية غير صالح، فإن بطلان هذا الحكم لن يؤثر على صحة الأحكام المتبقية من هذه الاتفاقية، والتي ستظل سارية المفعول بالكامل. لن يُعتبر أي تنازل عن أي شرط من شروط هذه الاتفاقية تنازلاً إضافيًا أو مستمرًا عن هذا الشرط أو أي شرط آخر، ولن يشكل فشل "لغز الحروف" في تأكيد أي حق أو حكم بموجب هذه الاتفاقية تنازلاً عن هذا الحق أو الحكم. أنت و"لغز الحروف" توافقان على أن أي سبب للدعوى ينشأ عن الخدمات أو يتعلق بها يجب أن يبدأ في غضون عام واحد (1) بعد نشوء سبب الدعوى. وإلا، فإن سبب الدعوى هذا يصبح محظورًا بشكل دائم.

التنازل

باستثناء ما هو منصوص عليه في هذه الوثيقة، فإن الفشل في ممارسة حق أو طلب أداء التزام بموجب هذه الاتفاقية لن يؤثر على قدرة أي طرف على ممارسة هذا الحق أو طلب مثل هذا الأداء في أي وقت بعد ذلك، ولا يشكل التنازل عن الإخلال تنازلاً عن أي إخلال لاحق.

إن عدم ممارسة أي من الطرفين لأي حق أو أي سلطة بموجب هذه الاتفاقية وعدم التأخير في ممارستها من جانب أي منهما لا يشكل تنازلاً عن هذا الحق أو السلطة. ولا يحول أي ممارسة فردية أو جزئية لأي حق أو سلطة بموجب هذه الاتفاقية دون ممارسة هذا الحق أو أي حق آخر ممنوح بموجب هذه الاتفاقية. وفي حالة وجود تعارض بين هذه الاتفاقية وأي عملية شراء أو شروط أخرى سارية، فإن شروط هذه الاتفاقية هي التي تحكم.

التعديلات على هذه الاتفاقية

تحتفظ شركة لغز الحروف بالحق، وفقًا لتقديرها الخاص، في تعديل أو استبدال هذه الاتفاقية في أي وقت. إذا كان التعديل جوهريًا، فسنقوم بإخطارك قبل 30 يومًا على الأقل من سريان أي شروط جديدة. سيتم تحديد ما يشكل تغييرًا جوهريًا وفقًا لتقديرنا الخاص.

من خلال الاستمرار في الوصول إلى تطبيقنا أو استخدامه بعد سريان أي تعديلات، فإنك توافق على الالتزام بالشروط المعدلة. إذا كنت لا توافق على الشروط الجديدة، فلن يُسمح لك بعد الآن باستخدام لغز الحروف.

الاتفاقية الكاملة

تشكل الاتفاقية الاتفاقية الكاملة بينك وبين لغز الحروف فيما يتعلق باستخدامك للتطبيق وتحل محل جميع الاتفاقيات السابقة والمعاصرة المكتوبة أو الشفهية بينك وبين لغز الحروف.

قد تخضع لشروط وأحكام إضافية تنطبق عند استخدامك أو شراء خدمات أخرى تقدمها لك شركة لغز الحروف، والتي ستوفرها لك شركة لغز الحروف في وقت هذا الاستخدام أو الشراء.

تحديثات على شروطنا

اتفاق التحكيم

ينطبق هذا القسم على أي نزاع باستثناء أنه لا يتضمن نزاعًا يتعلق بمطالبات بالتعويض القضائي أو الإنصافي فيما يتعلق بإنفاذ أو صحة حقوق الملكية الفكرية الخاصة بك أو بـ "لغز الحروف". يشير مصطلح "النزاع" إلى أي نزاع أو إجراء أو خلاف آخر بينك وبين "لغز الحروف" فيما يتعلق بالخدمات أو هذه الاتفاقية، سواء في العقد أو الضمان أو الضرر أو القانون أو اللوائح أو المرسوم أو أي أساس قانوني أو منصف آخر. سيتم إعطاء "النزاع" أوسع معنى ممكن مسموح به بموجب القانون.

إشعار بالنزاع

في حالة حدوث نزاع، يجب عليك أو على لغز الحروف إرسال إشعار بالنزاع إلى الطرف الآخر، وهو عبارة عن بيان مكتوب يوضح اسم وعنوان ومعلومات الاتصال الخاصة بالطرف الذي قدمه، والحقائق التي أدت إلى النزاع، والحل المطلوب. يجب عليك إرسال أي إشعار بالنزاع عبر البريد الإلكتروني إلى: [email protected]. سترسل لك لغز الحروف أي إشعار بالنزاع عبر البريد إلى عنوانك إذا كان لدينا، أو إلى عنوان بريدك الإلكتروني. ستحاول أنت ولغز الحروف حل أي نزاع من خلال المفاوضات غير الرسمية في غضون ستين (60) يومًا من تاريخ إرسال إشعار النزاع. بعد ستين (60) يومًا، يجوز لك أو على لغز الحروف بدء التحكيم.

التحكيم الملزم
